During the labor, the fetal heart rate monitor showed signs that the baby was in distress. However, there was a delay of several hours before the obstetrician finally decided to perform an emergency Cesarean section. The baby was born with severe neurologic injuries, including cerebral palsy. 1.5 million dollar wrongful death settlement — An internal medicine doctor in Boulder, Colorado, and his professional corporation, paid 1.5 million dollars to settle a case involving the death of a 35 year-old man. The patient had received a chest x-ray pursuant to the doctor’s request. The x-ray showed a nodule that was suspicious for cancer. No one ever informed the patient, and he thus received no treatment for three years. By that time, it was too late to save the patient’s life. The patient is survived by his wife and one year-old daughter. 1 million dollar medical malpractice settlement — A Denver man received one million dollars from an ear nose and throat surgeon who negligently performed endoscopic surgery. The surgeon drilled too far into the patient’s sinuses, creating a small hole in the skull, which then led to a cerebrospinal infection. $800,000 wrongful death settlement — The widower of a 32 year-old woman received an $800,000 settlement from an emergency medicine doctor. The patient had gone to the emergency room the day before she died complaining of shortness of breath and chest pain. The emergency room doctor attributed her symptoms to asthma and sent her home. Approximately eight hours later, the patient suffered a massive pulmonary embolism and died. $750,000 medical malpractice settlement — A general surgeon paid $750,000 to settle a lawsuit brought against him for his failure to follow up on an abnormal CT scan of his patient. The general surgeon had ordered a CT scan on the patient, a 55 year-old Denver man. The CT scan showed a large mass on his kidney. The radiologist correctly read the CT scan as being suspicious for kidney cancer and, in his written report, told the general surgeon that further follow up testing was required to determine if the patient had kidney cancer. The patient was never told about the results of the CT scan, and did not receive treatment for his cancer until three years later when he became symptomatic. The three year delay in treatment caused a significant reduction in the patient’s chances of survival. $750,000 wrongful death settlement — Our firm obtained a $750,000 settlement on behalf of the son of a 77 year-old man who died during an MRI procedure. The radiologic technician handed the radiologist the wrong type of contrast media, and the radiologist failed to look at the bottle and notice that he was about to inject the wrong substance into his patient’s spinal column. The patient suffered a severe reaction to the substance which was injected into the intrathecal space. The patient died. The settlement was reached with both the radiologist and the hospital where the MRI procedure was performed. $600,000 medical malpractice settlement — A Boulder woman was paid $600,000 to resolve her lawsuit against a cardiologist who negligently attempted a cardio conversion procedure to treat atrial fibrillation. As a result of the treatment, the patient suffered a stroke which caused permanent injuries including difficulties with her speech. $500,000 medical malpractice settlement — A general surgeon in Wyoming paid $500,000 to settle a lawsuit brought against him for negligently performing a hemorrhoidectomy.
