The child’s mother called her doctor’s office the day before her son was born and told the nurse that she was experiencing decreased fetal movement. 2.5 million dollar medical malpractice settlement
A 36-year-old man who had suffered kidney failure received a 2.5 million dollar settlement against his primary care provider and a physician assistant. The defense argued that the delay in treatment for kidney failure did not make a difference in the patient’s outcome.
2.2 million dollar birth injury settlement
The parents of a Cheyenne, Wyoming, baby obtained a $2.2 million settlement from an obstetrician and a hospital. The mother had delivered her first child by Cesarean section and, upon the advice of her obstetrician, was attempting a vaginal birth for her second child (VBAC). The fetal monitor strip showed signs of fetal distress, which went unnoticed by the labor and delivery nurse and the obstetrician. The mother’s uterus eventually ruptured, extruding the baby into the abdomen. Going without oxygen for several minutes, the baby suffered permanent brain damage.
2 million dollar dental malpractice verdict
A Denver jury returned a verdict of $2 million in favor of a 63-year-old woman who suffered a heart infection and bilateral vestibular damage as a result of the negligence of her dentist. The insurance company for the dentist never made any offer to settle the case. This is the largest dental malpractice verdict in the history of Colorado.
1.85 million dollar birth injury settlement
The parents of a 3-year-old boy received a 1.85 million dollar settlement from a Denver obstetrician and a Denver hospital for injuries that the boy had received during his delivery. During the labor, the fetal heart rate monitor showed signs that the baby was in distress. However, there was a delay of several hours before the obstetrician finally decided to perform an emergency Cesarean section. The baby was born with severe neurologic injuries, including cerebral palsy.

A Boulder woman received a 1.8 million dollar settlement from her family practice doctor after sustaining a serious injury that damaged her lungs and left her oxygen-dependent. 1.75 million dollar wrongful death settlement
Our firm obtained a 1.75 million dollar settlement for the widower of a 30-year-old woman who died from a pulmonary embolism. The decedent had undergone arthroscopic knee surgery and shortly thereafter developed chest pain and shortness of breath. None of the physicians that she saw for her complaints ever ordered a ventilation/perfusion scan or any other diagnostic test to rule out deep vein thrombosis or pulmonary emboli. The woman died two weeks later as a result of multiple pulmonary emboli.

A 38-year-old man died from a pulmonary embolism. Our firm represented his widow and their three young children. The patient had suffered a broken ankle and a couple of weeks later began experiencing shortness of breath, which is a sign of pulmonary embolism. He went to see his primary care doctor for his complaints of shortness of breath, but the primary care doctor did not check the patient’s respiratory rate or oxygen saturation level. Twelve hours after leaving the primary care doctor’s office, the patient died from a pulmonary embolism. Our firm obtained a $900,000 settlement against the primary care doctor.
$750,000 medical malpractice settlement
The Mahoney Law Firm, P.C., obtained a $750,000 settlement on behalf of a man with kidney cancer. The man had undergone a CT scan for an unrelated issue, and the CT scan showed a large mass on his kidney. The general surgeon who ordered the CT scan never informed the patient of the mass. Three years later, the patient became ill and was diagnosed with kidney cancer. As a result of the three-year delay in diagnosis, the patient’s prognosis for survival was significantly worse.
