First and foremost, you must be knowledgeable about the law in this area. Most of our cases settle before trial, but if a case does go to court, you must be able to litigate effectively. That includes knowing how to admit evidence and how to exclude improper evidence offered by the other side.

We focus on understanding the elements of the claims we are asserting or defending and ensuring we have the evidence to support them. Whether that evidence consists of documents or witness testimony, we are very effective at identifying, developing, and presenting it. We are also skilled at excluding evidence that should not be admitted.

Equally important is the attorney-client relationship. We are honest with our clients about what we can and cannot do. We do not make promises we cannot keep. One of our strengths is being objective about a case and clearly explaining its strengths and weaknesses, so clients do not spend significant money pursuing claims that are unlikely to succeed.

I have recently been selected as a Super Lawyer in estate and trust litigation and was also named a Top Lawyer by 5280 Magazine in Colorado for probate litigation. Each of these distinctions includes only a small number of attorneys. I am also the current co-chair of the Probate and Trial Committee, a subcommittee of the Estate and Trust Section of the Colorado Bar Association, which serves attorneys who practice in this area.

Biography

Andrea N. Mahoney is a partner at Mahoney Law LLC, who specializes in estate and trust litigation, fiduciary litigation, trust and estate administration, probate and estate planning. Andrea is the current Co-Chair of the Probate and Litigation Committee of the Trust and Estate Section of the Colorado Bar Association. While in law school, Mrs. Mahoney was the only student member of the National Academy of Elder Law Attorneys. Her studies emphasized issues concerning the elderly, estate and trust litigation, estate planning and tax matters. After law school, Mrs. Mahoney became employed with a top law firm focusing on these issues. Mrs. Mahoney then gained experience practicing complex commercial litigation for several years. She has successfully tried and arbitrated numerous cases and has successfully argued six cases to the Colorado Court of Appeals. Mrs. Mahoney’s extensive commercial litigation experience, coupled with her knowledge of the Colorado Rules of Civil Procedure and the law, have greatly enhanced her ability to litigate in this very specialized area of estate and trust litigation. Mrs. Mahoney has had many recent successes including defending the validity of a deed and claims for civil theft, breach of fiduciary duty, fraud and unjust enrichment; invalidating a trust, defending the validity of a will executed by an elderly woman with dementia who had recently been hospitalized, reforming a will, defending a beneficiary designation and resolution of actions seeking removal of a trustee. Mrs. Mahoney was one of only six attorneys in the state to be named as a Colorado Super Lawyer in 2026 in the category of Estate and Trust Litigation. She was also selected as a 5280 Top Lawyer (Probate Litigation) in 2026; less than 3% of the attorneys in the state are chosen as 5280 Top Lawyers.

Andrea is a frequent lecturer at continuing legal education conventions on topics related to estate and trust litigation.
