Our Recent Case Results
2026 – After succeeding in defending all claims at trial in June of 2025, Mahoney Law won the appeal to the Colorado Court of Appeals which issued its opinion in July of 2026. The Court of Appeals affirmed the trial court’s dismissal of all claims against our client and awarded our client her attorneys’ fees and costs in defending against the appeal. The award of fees and costs was the fourth such award during the course of this litigation.
2026 – The opposing party refused to produce two key witnesses for depositions, claiming that their testimony would be privileged. Mahoney Law prevailed on a motion to compel the opposing party to make these witnesses available for depositions, and the Court sanctioned the opposing party by awarding our client his attorneys’ fees and costs associated with filing the motion.
2026 – After winning a trial to invalidate a trust due to undue influence, and prevailing at the Colorado Court of Appeals, we succeeded in front of the Colorado Supreme Court in having the opposing party’s petition for writ of certiorari denied. The Colorado Supreme Court denied the petition after full briefing. Our attorneys handled the entire case at the trial court, Colorado Court of Appeals, and Colorado Supreme Court.
2026 – After a 2-day trial, the court ruled in favor of our client on all issues and invalidated a will based upon both undue influence and lack of capacity. The opposing party made no offer of settlement prior to trial.
2026 – After prevailing on all issues at trial, the Court awarded our client attorneys’ fees and costs for having to respond to a Motion for New Trial that the Court deemed to be groundless and frivolous.
2025 – After a three-day trial, successfully defended the validity of a Deed and claims for civil theft, breach of fiduciary duty, fraud, and unjust enrichment. Prior to trial, prevailed on a motion to dismiss several claims, which resulted in an award of attorneys’ fees and costs being assessed against the opposing party. After the trial, the judge awarded our client attorneys’ fees and costs a second time for having to respond to what the Court deemed to be a frivolous motion filed by the opposing party during the trial.
2025 – Successfully reformed a will resulting in our clients inheriting more than two million dollars that they would not otherwise have inherited.
2025 – Won appeal after an oral argument to the Court of Appeals, concerning the invalidation of an amended trust due to undue influence.
2024 – Defended the validity of a will executed by an elderly woman with dementia who had been hospitalized one week prior to executing her will. We settled the case with an extremely favorable result for our clients.
2023 – After a 3 1/2 day trial, successfully invalidated an amended and restated trust due to undue influence.
2023 – Successfully defended the validity of a beneficiary designation after a 1/2 day hearing.
