Trusts as Marital Assets
Andrea Mahoney is available to testify as an expert witness regarding what, if any, part of a trust is a marital asset. This issue typically arises in divorce proceedings. Andrea’s background makes her uniquely qualified to serve as an expert in this area. Early in her career, while working for Jack Berryhill (who later became a Jefferson County District Court Judge), in addition to handling complex commercial litigation matters, Andrea also tried divorce cases. Thus, she is knowledgeable about both family law and estates and trusts which qualifies her to opine about what, if any, part of a trust can be treated as a marital asset and/or used to determine how the marital assets should be divided between spouses.

Andrea is also qualified to serve as an expert witness regarding the duties and obligations of trustees and personal representatives. She has nearly thirty years of experience representing fiduciaries regarding the administration of estates and trusts, and she has litigated dozens of cases involving alleged breaches of fiduciary duty.
